1. Terms of Use

These terms and conditions define the legal terms applicable to your use of our website, www.imart.pt, both as a visitor and as a registered user. 

Please read these terms and conditions carefully and make sure you understand them before using our website. Please note that by using our website, you agree to these Terms and Conditions. If you do not agree with them, you should not use our website.

2. Content and Product Information 

I’M.ART will do everything possible to ensure that the information presented does not contain errors, and will be quickly corrected whenever they occur. If you purchase a product that has characteristics different from those presented online, you have the right to terminate the purchase contract under the applicable legal terms. The measurements shown (sizes and weights) are approximate and may contain measurement errors.

I'M.ART will do everything to ship all the products ordered, but there is a chance that, in certain cases and due to causes difficult to be controlled by I'M.ART, such as human errors or incidents in computer systems, this is not possible. 

If any product is not available after placing the order, you will be notified, by email or by phone. At that time you will be presented with the possibility to cancel the order with the respective refund, if you have already made the respective payment.

The Client cannot demand from I’M.ART, other compensation, interest or compensatory indemnities, in addition to the referred return, in case of stock rupture or for errors in the information provided on the website.

All information on prices, products, specifications and promotional actions may be changed at any time by I’M.ART.

3. Content and Product Information 

The Client undertakes to:

i) Provide personal data and correct addresses;

ii) Do not use false identities;

The ordering of products must be made by Clients aged 18 (eighteen) years or older (individuals under the age of one must have authorization from their representatives). The elements and information transmitted by the Client will enjoy full legal effects, recognizing the Client's electronic purchases, and the Client cannot claim the lack of signature for non-compliance with the obligations assumed.

If any of the data is incorrect or is insufficient, and for that reason there is a delay or impossibility in order processing, or eventual non-delivery, the responsibility lies with the Client, and I’M.ART declines any responsibility. In the event that the Client breaches any of these obligations, I'M.ART reserves the right to eliminate future purchases, block access to the store, cancel the supply of any other products and, further, not allow the Client's future access to any services provided by I’M.ART.

4. Privacy and Personal Data Protection

We only use your personal information in accordance with our Privacy Policy. Please read carefully as it includes important information about how we collect and use your data. By using the Website, you consent to the use of your data as described in our Privacy Notice and you guarantee that all data provided by you is correct.

5. Cancellation of Orders 

At the request of the Customer 

The Customer may cancel his order by requesting it to I’M.ART via email info@imart.pt, which will be accepted as long as it has not yet been processed. After its processing, I’M.ART will try to deliver it, but the Customer has the option of not accepting it.

For the purpose of cancellation, the Customer must indicate the following data to I’M.ART: a) Order number 

b) Fiscal Number with which you placed the order and delivery address 

By decision of I’M.ART 

I’M.ART reserves the right not to process orders when it finds any inconsistency in the personal data presented or observes misconduct on the part of the buyer. I'M.ART reserves the right not to process any order or refund, in the event of errors in the values ​​and / or characteristics of the products, when these arise from technical problems or errors beyond I'M.ART.

6. Return (Right of Withdrawal) 

The consumer can exercise the right of withdrawal (return) without being required any compensation, within 15 (fifteen) days from the day on which the consumer acquires physical possession of the property.

To exercise this right, the Client must send the completed form below to the email address info@imart.pt with the subject “Free Resolution”

The Customer must, within 15 (fifteen) days from the date of communication of the resolution, return the goods to I’M.ART by registered mail, under the appropriate conditions of use.

The packaging must be returned complete, as it was delivered and accompanied by all the documentation received, namely the sales invoice. The packaging and documents must be sent by registered mail to I’M.ART Jewellery Lda, Lg. Capitão Pinheiro Torres de Meireles 52, 1º, 4150-619, Porto. The Customer must always request the receipt that proves the order was sent. Shipping costs will be the responsibility of the Customer. Upon receipt of the return at I’M.ART, the amount corresponding to the amount paid for the order will be returned to the Customer (value of the sales invoice, including postage). If you used a promotional discount code, this amount will not be refunded, that is, the refund will only be for the amount actually paid.

The method of refunding the amount to be returned depends on the payment method used in the respective order. In the case of payments by credit card and PayPal, these are credited to the respective accounts. In the remaining cases, when Bank Account information is provided, the refund is made to the indicated bank account. Refunds are made up to 30 days after receipt of the free will resolution and receipt of the goods return.

In the absence of any of the components of the item sold or, if any of them are not in excellent condition, there will be no refund of the price or postage, and the product will be sent back to the initial shipping address.

7. Warranty 

Our pieces have a 2 year warranty.

Excluded from the guarantee are damages resulting from improper use, or contact with chemical agents that may cause damage to the materials of your piece.

If you are facing any non-compliance, send an email with the subject "Warranty" to info@imart.pt, and indication of the product reference, number and date of the invoice and address of the Customer to resend the piece. You should then send the piece, via registered mail, for our analysis to I’M.ART Jewelery Lda, Lg. Capitão Pinheiro Torres de Meireles 52, 1º, 4150-619, Porto. The Customer must always request the receipt that proves the order was sent. Shipping costs will be the responsibility of the Customer.

After analyzing and confirming the validity of the warranty, the product will be repaired or replaced, without any additional cost and returned to the indicated address and email sent.

8. Communications

Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the Customer that relate to the Store may be made to the Customer's email address, by SMS or telephone contact.

The Customer agrees to receive any and all communication and / or notification related to the Online Store, to the address, contact phone number and or email address (“email”) indicated in the ordering process.

At any time, you can request not to receive these communications and / or notifications through the Contact Form or through the option "Do not receive the Newsletter" registered in each Newsletter.

10. Applicable Law

The parties agree that their relations will be governed exclusively by these terms and conditions and the additional information available on the website. In the case of omission of any condition, this will be considered regulated by the customs and practices in force in the distance selling sector, in accordance with the rules of the Ethical Code and Fair Practices of AMD Portuguese Association of Direct Marketing and other legislation in force.

All products sold in the Online Store I’M.ART are in accordance with Portuguese law.
